TERMS OF SALES
If you wish to purchase any product or service made available through our Online Store, you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information. You represent and warrant that: you have the legal right to use any credit card(s) or other payment method(s) about any Purchase; and that the information you supply to us is true, correct and complete. By submitting such information, you grant us the right to provide the information to third parties for purposes of facilitating the completion of Purchases. We reserve the right to refuse or cancel your order at any time for certain reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order or other reasons. If one or more of the items purchased is unavailable for any reason, a replacement item will be suggested by our shop representatives. In the case that the price of the replacement item is greater than the original item, the difference must be paid for in cash prior to receiving the order. In the case that the price of the replacement item is less than the original item, no store credit will be applied and no cash refund will be given. If a replacement is not suitable, then the price of the unavailable item/s will be applied as store credit with a three (3) months expiration date. We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.
STOCKS AVAILABILITY, RATES AND DISCREPANCIES
We are constantly updating our offerings of products and services on our Online Store. The products or services available may be mispriced, described inaccurately, or unavailable, and we may experience delays in updating information on our website and in our advertising on other websites. We cannot and do not guarantee the accuracy or completeness of any information, including prices, product images, specifications, availability, and services. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.
DELIVERY TERMS
Customer is required to make advance payment and provide correct and complete information necessary for the delivery. Delivery will not be made until the advance payment has been received or the complete delivery information has been provided. Unless otherwise indicated for a specific delivery date, Txanton will deliver the products 3 days within the date of order. The customer is required to send Txanton written notice of default in case of late delivery, allowing Txanton a reasonable period of at least 10 working days to fulfill its obligations. Delivery does not include the transportation or relocation of the goods within the customer’s premises.
The customer shall take delivery of the purchased goods. The risk of loss of goods will pass to the customer from the moment Txanton delivers them to the customer in accordance with the contract. If the customer refuses to take the delivery for any reason whatsoever, all cost of storage will be for his account.
The customer shall offer his help, free of charge, with the unloading and receipt of the products. Any damage caused when unloading the goods will be for the customer’s risk if such damage results from improper performance by the customer or by the persons, material or mechanical means available by him.
Upon delivery of the goods, the customer shall check them for any visible defects or shortcomings. The customer shall particularly check whether the sold goods are within the best-before date and whether the bar codes on the products are correct. Any visible shortcomings or faulty of the product shall be reported to Txanton in writing within 5 hours upon receipt of the item and, where possible, to the carrier upon delivery. Notification of such may be made via email. Proof of transmission or posting must be obtained. If Txanton believes the complaint is founded, it shall replace the goods concerned within a reasonable period. If a replacement is not suitable, then the price of the unavailable item/s will be applied as store credit with a three (3) months expiration date. Goods received may be returned but subject for change of item only with Txanton’s approval.
The customer shall take all due care to properly store and handle the goods delivered by Txanton.

LIMITATION OF LIABILITY
In no event shall Txanton Torre Wine and Olive Oil Co. Inc, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

activities about a voucher purchased or redemption of that voucher on the Site, Txanton is entitled to close your account and/or require a different means of payment.
RETURN AND REFUND POLICY
Due to the nature of our merchandise, Txanton do not honor any returns and refunds. The customer shall check the item within the first 5 hours upon receipt of the item and, where possible, to the carrier upon delivery and inform Txanton for any visible inadequacies of the product.
The customer shall take all due care to properly store and handle the goods. Customer’s failure to do so, Txanton will not be held liable for any damages on the organoleptic properties.
EXCHANGES
We will replace the item if the wrong product was delivered by mistake. Kindly check the item within the first 5 hours upon delivery and send us a message through web@txanton.com.ph if you need an exchange. We will get in touch with you regarding next steps. |
